These General Terms and Conditions ("Terms") govern your use of FilmFlow Pro, a cloud-based film production management platform operated by high5 ventures GmbH, Speicherstr. 1, 60327 Frankfurt am Main, Germany ("we", "us", "our"). By creating an account or using our service, you agree to these Terms.
By registering for an account or accessing FilmFlow Pro, you confirm that you have read, understood, and agree to be bound by these Terms. If you are using the service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity. If you do not agree with these Terms, you may not use the service.
FilmFlow Pro is a web-based platform for film and video production management. It provides tools for script editing, storyboarding, shot planning, scheduling, budgeting, team collaboration, and AI-assisted features. The service is provided as a Software-as-a-Service (SaaS) solution accessible via modern web browsers. We reserve the right to modify, enhance, or discontinue features at any time with reasonable notice.
To use FilmFlow Pro, you must create an account with a valid email address and a secure password. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You must notify us immediately at contact@filmflow.pro if you become aware of any unauthorized use. You must be at least 16 years of age to create an account. Account registration is free of charge.
FilmFlow Pro offers a free tier and optional paid credit packs for AI-powered features. All payments are processed by Stripe, Inc.
The free tier includes core production management features (script editing, storyboarding, scheduling, budgeting, team collaboration). No credit card is required. We reserve the right to adjust the scope of the free tier with reasonable notice.
AI-powered features (such as scene analysis, breakdown suggestions, and schedule optimization) consume credits. Credits can be purchased in packs via Stripe. Credits do not expire and are non-refundable once used. Prices are displayed inclusive of applicable VAT (Mehrwertsteuer) in accordance with § 1 UStG. All prices shown to consumers within the EU include the applicable statutory VAT.
If you are a consumer within the EU, you have a 14-day right of withdrawal under § 312g BGB and the EU Consumer Rights Directive. However, by purchasing credit packs and expressly consenting to immediate delivery of digital content, you acknowledge that the right of withdrawal is lost once credits are delivered to your account (§ 356 Abs. 5 BGB). You will be asked to confirm this waiver before each purchase.
You agree not to use FilmFlow Pro to:
You retain all intellectual property rights to the content you create, upload, or store on FilmFlow Pro, including scripts, storyboards, shot plans, schedules, and budgets. By using the service, you grant us a limited, non-exclusive license to process and store your content solely for the purpose of providing and improving the service. We do not claim ownership of your content and will not use it for purposes other than operating the platform.
The FilmFlow Pro platform, including its source code, design, user interface, documentation, and branding, is the intellectual property of high5 ventures GmbH and is protected under German copyright law (UrhG) and applicable international copyright treaties. All rights not expressly granted in these Terms are reserved.
FilmFlow Pro includes optional AI-powered features that use the Google Gemini API to analyze script content and generate suggestions (e.g., scene titles, breakdown suggestions, schedule optimization). AI features are activated only at your explicit request. We do not guarantee the accuracy, completeness, or suitability of AI-generated output. You are solely responsible for reviewing and validating any AI-generated content before relying on it for production decisions. AI-generated content does not constitute professional advice. Your script text is transmitted to the AI provider only when you explicitly trigger an AI feature — see our Privacy Policy for details on data processing.
We process personal data in accordance with the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG). For detailed information about what data we collect, how we use it, your rights as a data subject, and the third-party processors we work with, please refer to our Privacy Policy at /privacy. By using FilmFlow Pro, you acknowledge that you have read our Privacy Policy.
FilmFlow Pro is currently in beta. The service is provided "as is" and "as available" without any warranty of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement, to the extent permitted by applicable law. We do not guarantee uninterrupted or error-free operation and do not offer a Service Level Agreement (SLA) during the beta phase. We will make reasonable efforts to maintain service availability and to notify you of planned maintenance. Mandatory statutory warranty rights (gesetzliche Mängelhaftung) remain unaffected.
To the extent permitted by German law: (a) We are fully liable (unbeschränkte Haftung) for damages caused by intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit), for injury to life, body, or health, and for claims under the German Product Liability Act (Produkthaftungsgesetz). (b) For breaches of essential contractual obligations (wesentliche Vertragspflichten / Kardinalpflichten) caused by ordinary negligence, our liability is limited to the foreseeable, typically occurring damages. (c) Any further liability for damages caused by ordinary negligence is excluded. (d) These limitations apply regardless of the legal basis of the claim, whether contractual, tortious, or otherwise. Mandatory statutory provisions remain unaffected.
You may delete your account at any time from your account settings. Upon deletion, your personal data will be purged in accordance with our Privacy Policy (within 30 days). Project data shared with team members may be retained in the project context until the project owner deletes it. We may suspend or terminate your account if you materially breach these Terms, in particular the Acceptable Use provisions, after providing you with reasonable notice and an opportunity to remedy the breach, unless immediate action is required to prevent harm to other users or our systems. In the event of termination by us, unused purchased credits will be refunded on a pro-rata basis.
We may update these Terms from time to time. If we make material changes, we will notify you at least 30 days in advance via email or an in-app notification (Textform per § 126b BGB). Continued use of the service after the effective date of changes constitutes acceptance. If you do not agree with the updated Terms, you may terminate your account before the changes take effect. Non-material changes (e.g., corrections, clarifications) may take effect immediately upon posting.
These Terms are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer habitually resident in the EU, you also benefit from any mandatory provisions of the consumer protection laws of your country of residence. The exclusive place of jurisdiction for all disputes arising from or in connection with these Terms is Frankfurt am Main, Germany, provided you are a merchant (Kaufmann), a legal entity under public law, or a special fund under public law. For consumers, the statutory provisions on jurisdiction apply. The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr — we are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).
